Hey there! We know legal pages are usually pretty boring, but these rules help keep our community safe and functioning. By accessing our platform, you agree to be bound by these guidelines.

1. Acceptance of Terms

By accessing and using the ModVoice platform ("Service"), accessible from modvc.org, you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to abide by these terms, strictly limited to the foregoing, please do not use this Service.

2. Description of Service

ModVoice provides a web-based, real-time voice and video communication platform utilizing Peer-to-Peer (P2P) WebRTC technology. The Service allows users to create virtual rooms, servers, and channels to communicate via audio, video, and screen sharing.

We reserve the right to modify, suspend, or discontinue the Service at any time, with or without notice. We shall not be liable to you or to any third party for any modification, price change, suspension, or discontinuance of the Service.

3. User Accounts & Security

  • Eligibility: You must be at least 13 years of age to use this Service.
  • Account Security: You are responsible for maintaining the security of your account and password. ModVoice cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.
  • Accuracy: You agree to provide true, accurate, current, and complete information about yourself during the registration process.
  • Account Deletion & Grace Period: You may request to delete your account at any time. To protect against malicious account takeovers, deletion requests require email OTP verification. Once verified, your account enters a 14-day grace period. During this grace period, your account is securely locked—you will be unable to send messages, join servers, create developer applications, or make purchases. You may cancel the deletion process at any time during this window by logging back into your account and navigating to your settings. If not cancelled, your personal data will be permanently purged and your messages anonymized after 14 days.

4. Acceptable Use Policy

ModVoice maintains a zero-tolerance policy for harassment and illegal content.

You agree not to use the Service to:

  • Upload, post, host, or transmit unsolicited email, SMSs, or "spam" messages.
  • Transmit any worms or viruses or any code of a destructive nature.
  • Violate any local, state, federal, or international laws.
  • Harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability.
  • Interfere with or disrupt the integrity or performance of the Service or the data contained therein.

5. Anti-Abuse & API Integrity

Circumventing frontend UI constraints via raw API requests is strictly prohibited.

ModVoice implements strict server-side and client-side constraints. You agree that you will not:

  • Use automated scripts, bots, cURL, Postman, or any other unauthorized means to interact with our backend APIs or databases.
  • Attempt to artificially manipulate marketplace prices, server boost counts, or user statistics.
  • Exploit or bypass maximum quantity limits, price caps, or security rules defined by the platform.

Violation of this clause will result in the immediate and permanent termination of your account, forfeiture of any hosted digital assets, and potential legal action.

6. Automated Moderation & Trust & Safety

Exception for Personal DMs: The moderation systems described below apply exclusively to Public Server Channels. Personal 1-on-1 Direct Messages (DMs) are protected by End-to-End Encryption (E2EE) and are entirely exempt from AI scanning, automated moderation, or administrative review.

To ensure a safe environment in public spaces, ModVoice utilizes an automated Trust & Safety system powered by AI (Mistral). By using the Service, you agree to the following moderation processes for Server communication:

  • Report Thresholds: Server items (messages or entire servers) are only flagged for review once they receive reports from at least three (3) unique users. This prevents targeted spam and abuse of the report system.
  • AI Text Review: Text-based reports are evaluated by our AI moderation engine to determine violations of our Acceptable Use Policy. The AI does not evaluate media (images, video, files).
  • Media & Manual Review: Reports containing media or concerning entire servers are escalated directly to human administrators for manual review.
  • Strike System & Suspensions: Confirmed violations result in escalating strikes: Strike 1 (Warning), Strike 2 (24-Hour Timeout), and Strike 3 (Permanent Suspension). Strikes decay over 30 days of good behavior. ModVoice administrators reserve the right to bypass the strike system and issue immediate permanent bans for severe violations.
  • False Report Penalties: Submitting malicious or intentionally false reports will result in penalties and strikes being applied to the reporter's account.

7. Intellectual Property

Your Content: You retain all rights and ownership of your content (profile images, server banners). By uploading content, you grant ModVoice a non-exclusive license to use, reproduce, and display such content solely for the purpose of providing the Service.

Our Property: The visual interfaces, graphics, design, compilation, information, computer code, and software are the property of ModVoice and are protected by copyright, patent, and trademark laws.

8. End-to-End Encrypted Media & Vaults

ModVoice employs strict zero-knowledge encryption (AES-GCM 256-bit) for Direct Messages, media attachments, and the E2EE Vault. We mathematically cannot decrypt, view, or moderate the contents of your E2EE messages or media.

You are solely responsible for securely managing your Vault Key. Because we act exclusively as a blind transport layer for encrypted blobs, ModVoice cannot recover your E2EE data if you lose your Vault Key. Furthermore, you are solely responsible for the content you send via our E2EE channels and must comply with all applicable laws.

9. Zero-Liability Monetization & Payments

ModVoice acts strictly as a technological conduit and assumes zero financial liability for transactions.

  • Bring Your Own Gateway (BYOG): ModVoice utilizes a decentralized payment routing system. When a user purchases a digital good or server boost, the transaction is processed directly through the respective Server Owner's integrated Stripe account. ModVoice never holds, processes, or touches fiat currency.
  • Merchant of Record: The Server Owner acts as the sole Merchant of Record. By integrating their Stripe API keys, Server Owners agree to bear full legal and financial responsibility for tax compliance, fraud prevention, chargebacks, and the delivery of digital goods.
  • Zero Platform Fees: ModVoice does not take a percentage cut of transactions. 100% of the purchase price (minus Stripe's standard processing fees) is routed directly to the Server Owner.
  • Marketplace Integrity: You may not list fraudulent items, misleading digital goods, or items priced with the intent of laundering money or bypassing platform limits. ModVoice reserves the right to nuke any listing or server violating this trust without warning.
  • Refunds & Disputes: Because ModVoice does not process or hold funds, we cannot issue refunds. All refund requests, disputes, or chargebacks must be directed exclusively to the Server Owner. ModVoice will not intervene in financial disputes between users and Server Owners.

10. Local Storage & Cookie Policy

We primarily rely on your browser's local storage rather than traditional tracking cookies to keep ModVoice fast, private, and secure. We do not use third-party tracking cookies to serve you targeted advertising. Here is exactly what we store locally on your device:

  • Authentication Tokens: Secure session keys to keep you logged into the hub without needing to re-enter your password constantly.
  • Device Cryptographic Keys: Because our Direct Messages (DMs) use End-to-End Encryption (E2EE), your private encryption keys are generated and stored locally on your device. We never see these keys. If you clear your local storage, you will temporarily lose access to your encrypted message history until you re-enter your private key or recovery passkey to restore access.
  • UI Preferences: We save minor layout choices, such as whether your sidebar is collapsed, your selected theme, and notification preferences.
  • Drafts & Unsent Content: Text you are actively typing in chat boxes is temporarily saved so you don't lose your progress if you accidentally refresh the page.
  • Stripe Checkout States: Temporary session IDs when you are purchasing products from a creator's store, ensuring your cart and checkout process resume smoothly.

11. Termination

We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

12. Disclaimers & Limitation of Liability

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. ModVoice makes no warranty that (i) the service will meet your specific requirements, (ii) the service will be uninterrupted, timely, secure, or error-free.

In no event shall ModVoice, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.

13. Governing Law

These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which ModVoice operates, without regard to its conflict of law provisions.

14. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
